WATERTOWN, New York (WWNY) – Felony charges have been filed against a husband and wife who crashed their separate vehicles into each other in the town of Philadelphia two months ago.

On the night of December 5, the Jefferson County Sheriff’s Office said a pickup truck driven by 43-year-old Nicky Stone and an SUV driven by 43-year-old Linda Stone collided head-on on Elm Ridge Road.

Both vehicles were totaled and were taken to the sheriff’s office impound lot. (Photos of the vehicles are at the end of this article.)

The couple was seriously injured in the crash.

On Tuesday, the Stones were each charged with a felony count of first-degree vehicular assault, and a misdemeanor count of aggravated driving while intoxicated.

Nicky Stone is accused of having a blood alcohol content of .22 percent, nearly triple the legal threshold of .08 BAC.

Linda Stone’s alleged BAC was .19 percent.

The husband and wife were also ticketed for failure to keep right and speeding.

In addition, Nicky Stone was ticketed for failure to wear a seatbelt.

Officials say there’s no indication the crash was intentional. They declined to say where the Stones were coming from when they collided.
